These Terms & Conditions (“Terms”) govern the use of the website web-power.gr (the “Site”), as well as the purchase of services, plugins, themes, and software products (“Products”) offered by Ioanna Chitou, Tax ID (ΑΦΜ) 112475614, Tax Office (ΔΟΥ) KEFODE ATTIKI, registered at Pl. Konstantinoupoleos 7, Athens, Greece (“we”, “us”, “the Company”), contact: info@web-power.gr.
By accessing the Site or purchasing any Product/Service, you unconditionally accept these Terms. If you do not agree, please do not use the Site or make a purchase.
1. Definitions
- “Services”: custom website/application development, performance optimization, API integrations, managed support, and any other service described on the Site.
- “Products”: WordPress plugins, themes, and SaaS solutions offered for sale/subscription, either through the Site or through a third-party payment and licensing provider (Freemius).
- “Customer” / “you”: any individual or legal entity using the Site or purchasing a Product/Service.
2. Custom Web Development Services
2.1. Custom development services (websites, applications, integrations, bespoke plugins) are provided under a separate written agreement/quote with the respective client, which sets out the scope of work, cost, timeline, and delivery terms.
2.2. In case of conflict between these Terms and a specific written agreement/quote for a given project, the specific agreement prevails.
2.3. Delivery timelines are indicative unless a binding schedule has been expressly agreed.
3. Sale of Software Products (Plugins / SaaS) via Freemius
3.1. Certain Products (e.g. WordPress plugins) are offered for sale or subscription through the third-party platform Freemius Inc. Freemius acts as the merchant of record for the relevant transactions, handling payment, invoicing, license distribution, and may apply its own terms of use, which apply in addition to these Terms. 3.2. The code of WordPress plugins distributed through this Site/Freemius is licensed under GPLv2 or later (GNU General Public License), in line with WordPress/WooCommerce ecosystem compatibility requirements. Your purchase covers access to the source code, updates, and technical support for a defined period — it does not restrict the redistribution/ modification rights already granted to you under the GPL.
3.3. The number of licensed sites and/or the validity period of a license are specified on the relevant Product page at the time of purchase.
4. Payments & Billing
4.1. Prices are listed on the Site or on the Product’s Freemius page and may or may not include VAT, depending on the Customer’s country — Freemius calculates and remits applicable VAT where required (One-Stop-Shop / VAT MOSS).
4.2. For custom Services, billing is handled directly by the Company based on the agreed quote, with an invoice/receipt in accordance with Greek law.
5. Refund Policy
5.1. Software Products (plugins/SaaS via Freemius): A refund is available within [FILL IN NUMBER OF DAYS — e.g. 14] days of purchase, provided the Product does not match its description or has a technical issue that cannot be resolved by technical support. Refund requests are submitted via the Freemius platform or to info@web-power.gr.
Note to you: For digital content delivered immediately (such as software/downloads), EU consumer protection law provides a 14-day right of withdrawal, which may be waived if the customer expressly consents to immediate performance/delivery and acknowledges losing the withdrawal right (typically via a checkbox at checkout). Freemius has a built-in flow for this in its checkout — worth checking that it’s configured to match what you state here.
5.2. Custom Services: No refunds are provided for work already performed. Deposits for projects cancelled before work begins may be refunded by agreement, less any costs already incurred.
6. Support & Updates
6.1. The support and update period per Product is specified on the purchase page (e.g. 1 year from purchase, renewable).
6.2. Support covers bug fixes and usage questions for the Product as distributed — it does not cover custom configuration, bespoke code modifications, or issues caused by third-party plugins/themes or unsupported WordPress/PHP versions, unless otherwise agreed.
7. Intellectual Property
7.1. The Site’s content (text, graphics, logo) belongs to the Company, unless stated otherwise.
7.2. Code for custom Services delivered to a client becomes the client’s property upon full payment, unless otherwise agreed in writing (e.g. use of third-party libraries under their own licenses).
7.3. Plugins distributed under GPL are governed by GPL terms regarding redistribution/modification (see §3.2).
8. Limitation of Liability
8.1. Products and Services are provided “as is”, without any warranty of fitness for a particular purpose beyond what is expressly stated in the relevant Product description.
8.2. The Company is not liable for indirect, incidental, or consequential damages (e.g. loss of revenue, data, or clientele) arising from the use or inability to use Products/Services, to the maximum extent permitted by law.
8.3. The Company’s total liability to a Customer, for any cause, shall not exceed the amount paid by the Customer for the relevant Product/Service.
9. Acceptable Use
You may not use the Site or Products for: unlawful activities, distribution of malicious software, infringement of third-party rights, or any action that compromises the security or operation of the Site or third-party systems.
10. Data Protection
The processing of personal data is described in the Site’s Privacy Policy. For purchases made via Freemius, Freemius’s own privacy policy also applies.
11. Changes to These Terms
The Company reserves the right to modify these Terms at any time. The updated version will be posted on the Site with an indication of the last update date. Continued use after such modification constitutes acceptance of the new Terms.
12. Governing Law & Jurisdiction
These Terms are governed by Greek Law. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of Athens, without prejudice to any mandatory consumer protection law of the Customer’s country of residence, where applicable.
